Історія виникнення та сучасний стан покарання у виді тримання у дисциплінарному батальйоні військовослужбовців

Abstract

Висвітлено історію виникнення покарання у виді тримання в дисциплінарному батальйоні військовослужбовців. Проаналізовано кримінальне законодавство України, яке регламентує цей вид покарання, дано його кримінально-правову характеристику, розглянуто стан дотримання і забезпечення прав та обов’язків категорії громадян, які відбувають покарання у виді тримання в дисциплінарному батальйоні військовослужбовців, зроблено спробу охарактеризувати сучасний стан і тенденції розвитку цього виду покарання в кримінальному праві України. The article deals with the history of the beginning of the penalty of detention in a disciplinary military unit, an analysis of the criminal legislation of Ukraine, which regulates this type of penalty is carried out, its criminal and legal description is given, the state of compliance and the rights and obligations of categories of citizens serving sentences in the form of detention in a disciplinary military unit is noted, the current state and trends of the prescribed punishment in the criminal law of Ukraine is characterized. The analysis of penalty application of detention in a disciplinary military unit indicates that this type of punishment is quite an effective tool to combat crime conscripts as most soldiers during serving of punishment are on the path of correction and after the release from the disciplinary unit serve faithfully. However, there is a clear need for detailed legal analysis of penalty of life imprisonment as the main punishment for Criminal Code of Ukraine The military unit where prisoners are serving the proposed punishment is a disciplinary battalion. It is located separately from the other units of the garrison, its territory is isolated and under guard. In disciplinary battalion the strict regulation of all aspects of prisoners is set up. You could even say that in its basic characteristics it is similar to the regime in the institutions of punishment of imprisonment for a specified period. So, incidentally, p. 72 Criminal Code of Ukraine states that in the preparation of punishment one day of imprisonment for a period corresponding to one day detention in a disciplinary military unit. Specified mode is intended to provide a correction and prevent them committing new crimes and bring their high discipline and honest attitude towards military service and labor, accurate and continuous observance of imposed on them as soldiers and citizens’ duties realization of their rights and interests, supervision and protection, personal security of individuals and military personnel of the battalion. The aim of the research is to study and analyze criminal penalty of detention in a disciplinary military unit and also a practice of its application.
