Прогалини у правовому регулюванні мовної інтеграції іммігрантів в Україні

Abstract

Проаналізовано нормативно-правову базу, що врегульовує питання мовної інтеграції іммігрантів в Україні. Доведено, що законодавство в цьому розрізі має низку недоліків і вимагає вдосконалення, зокрема врахування Загальноєвропейських Рекомендацій з мовної освіти. Здійснено порівняння польського та українського законодавства у сфері регулювання державної мовної політики щодо іммігрантів. Запропоновано внести певні зміни і доповнення до до законів України, зокрема «Про громадянство України» від 18 січня 2001 року. The article analyzes the legal framework that regulates the language integration of immigrants in Ukraine, makes a comparative analysis of Ukrainian and Polish law regulating the mentioned issue. As it turned out, some gaps in the legal regulation of language integration of immigrants are available in Ukrainian legislation. This problem is manifested in the absence of legal provisions dealing with matters of state certification of knowledge of Ukrainian language as a foreign one by persons who want to acquire Ukrainian citizenship. In addition, the Ukrainian legislation does not take into account the European recommendations on language education concerning the levels of proficiency, such as in Poland. The decree of 27 June 2006 number 588/2006, which approved «The order of proceedings for applications for citizenship of Ukraine and the order of the decisions» fails to ground a wide (and a rather vague) range of authorized subjects eligible to determine proficiency and knowledge of the state language and submit appropriate certificates. The above-mentioned issue is associated with lack of the state standard of Ukrainian language as a foreign one and formal approaches set out in the regulations concerning the duty to learn the state language by immigrants for their integration into Ukrainian society. To remove the indicated gaps is possible in the process of preparation of the new Law on state (Ukrainian) language and through introducing amendments to the law of Ukraine «On Citizenship of Ukraine» regarding the duties envisaged for the citizenship of Ukraine.
