Специфіка правового режиму судового рішення у господарському процесі

Abstract

Розкрито сутнiсть та елементи юридичної категорії «правовий режим». На основi аналізу ознак сформульовано поняття правового режиму судового рiшення у господарському процесi, а також його теоретичне і практичне значення. Обґрунтовано змiст правового режиму судового рiшення та елементи, якi становлять його складову. З’ясовано вiдповiднiсть правового режиму судового рiшення вимогам законодавства. Розглянуто дефiнiцiю правового режиму судового рiшення у господарському процесi в контекстi зазначених нормами права форми та змiсту судового рiшення, вимог, що до нього ставляться, порядку прийняття рiшення та набрання ним законної сили. The article deals with the essence and elements of the legal category of «legal regime». Based on the analysis, the concept of the legal regime of the judicial decision in the economic procedure is formed, as well as its theoretical and practical importance. The essence of the legal regime is revealed by means of the analysis of features. The content of the legal regime of the judicial decision and its elements are substantiated. The conformity of the legal regime of the judicial decision with the requirements of the legislation is analyzed. The definition of the legal regime of the judicial decision in the economic procedure in the context of the form and content of the judicial decision, requirements that refer to it, the decision-making procedure and coming it into legal force are considered. This problem is relevant, as the development of the modern society is gaining rapid momenta, because of expanding the scope of the legal regulation of social relations that, in turn, creates the need for use of comprehensive and systematic solving problems, by means of enforcement and legality, renovating the quality of regulation. Only the legal regime is able to ensure the optimal regulation of social relations and the achievement of socially meaningful result, namely the creation of a favorable regime for lawful actions of the subjects in implementation of their own interests and an unfavorable regime for illegal actions. In other words, it is a legislative model of social relations established by the state, and it is provided by the system of legal means. A study of the legal regime of the judicial decision in the economic procedure is reflected in the scientific papers of such scholars as O. Kot, V. Hryhorieva, S. Aleksieiev, M. Matuzov, O. Malko, H. Beliaieva, S. Vilnianskyi, M. Hurvych, N. Chechina, V. Lazariev, D. Polumordvinov, M. Strohovych, and M. Aleksandrova.
