Умови призначення компенсаційних витрат за надання соціальних послуг в Україні

Abstract

Досліджено особливості призначення компенсаційних виплат непрацюючим фізичним особам, які безкоштовно надають соціальні послуги. З’ясовано умови та порядок надання цього виду соціального забезпечення; обґрунтовано, що умовою отримання компенсації є відсутність будь-якого доходу протягом часу надання соціальних послуг за винятком результату від праці вдома на підставі трудових правовідносин та підтвердження фак-ту здійснення постійного догляду, одним із яких запропоновано вважати обов’язкове проведення обстеження матеріально-побутових умов надання соціальних послуг. Проаналізовано положення чинного законодавства України, держав зарубіжжя, матеріали судової практики, наукові напрацювання та пропозиції щодо вдосконалення правового регулювання у сфері призначення компенсацій-них виплат за надання соціальних послуг. The article deals with the features of the allotment of compensatory payments to unemployed physical persons who provide social services to disabled citizens free of charge. The paper considers the conditions and procedure for granting this type of social security. It is concluded that a monthly monetary compensation is appointed to the provider of social services during the time when he is providing services and excluding his financial state. Such compensation provides additional material support at the expense of local budgets in order to reimburse lost earnings (income) to the provider of social services. Social services are connected with the exercise of the regular care of the elderly, the disabled, and children with disabilities, the sick who are not capable to self-service and need constant outside assistance (except those who are served by social services). It is proved that the condition for obtaining compensation is the lack of any material benefits for the social services, except for the work at home based employment relations. The implementation of the right to the compensatory payment depends on not only the declaration of the provider’s will but also a recipient of social services or his legal representative, which is expressed by an application for the need of the provision of social services. This legislation does not provide ways to confirm the fact of realization of constant care, one of which is the Act of examination of the material and domestic conditions for the provision of social services. The provisions of the current legislation of Ukraine and foreign countries, the records of the court practice are analyzed. The suggestions of improving the legal regulation in the field of the allotment of the compensatory payments for rendering social services are made.
