Міжнародний досвід реалізації права доступу громадян до публічної інформації

Abstract

Досліджено міжнародну практику, пов’язану з актуальними питаннями права доступу громадян до публічної інформації. На підставі теоретичного обґрунтування проаналізовано міжнародно-правові акти, які реалізують право громадян на інформацію. Встановлено, що досвід окремих зарубіжних країн щодо забезпечення громадянам доступу до публічної інформації дав змогу стверджувати, що правове регулювання права громадян на доступ до публічної інформації є однією з найважливіших гарантій становлення будь-якого демократичного суспільства. Визначено, що загалом міжнародна практика держав, які прийняли закони про доступ до публічної інформації, свідчить про позитивний вплив таких законодавчих змін на реалізацію громадянами основоположних прав, підвищення ефективності діяльності органів влади, а також зменшення ризиків корупції в діяльності інформативної сфери. In the scientific article the international practice related to current matters right of access to public information. Based on the theoretical study analyzed international instruments that implement citizens’ right to information. It was established that the experience of some foreign countries to provide citizens access to public information has made it possible to assert that the regulation of citizens’ right to access to public information is one of the most important guarantees of formation of any democratic society. On the basis of scientific evidence analyzed in the context of international regulatory experience right of public access to public information in countries such as the USA, Germany, the United Korolivstvayi, France, Hungary, Sweden, Czech Republic and other EU countries. Systemized permissible restrictions on freedom of public information, which are used in international practice and further use require detailed legal justification. It was established that the national legislation of many countries have common regulations (generally laws) that govern the right of citizens to information, but most of them related to access to information that is held by public authorities. Proved that international experience shows that the process of access to public information on its carrier (the owner) to the user can be both directly and through information intermediaries. The role of the mediator often perform media. Determined that in general international practice of countries have adopted laws on access to public information, evidence of the positive impact of legislative changes on the implementation of the citizens fundamental rights, improve the efficiency of government and reducing the risk of corruption in the informative sphere.
