Забезпечення охорони громадського порядку органами місцевої виконавчої влади та місцевого самоврядування

Abstract

Порушено питання забезпечення охорони громадського порядку органами місцевої виконавчої влади та місцевого самоврядування. Розкрито сутність охорони громадського порядку як надзвичайно важливого об’єкта соціального управління, який є неодмінною засадою нормального існування громадянського суспільства і функціонування всіх його структур. Висвітлено проблеми організації забезпечення публічної безпеки органів місцевої виконавчої влади та місцевого самоврядування. The article deals with ensuring the protection of the public order by local executive bodies and local self-governments. Protection of public order is a very important object of social administration, which is a necessary precondition for the normal existence of civil society and functioning of all its structures (political, economic, and cultural). The weakening of the function of public order protection causes the increasing of administrative offences and crimes, the sharp decreasing of the culture of human communication, the damage of public property in public places, the violation of sanitary and environmental regulations. The offenses come into contradictions with the generally accepted rules of human behavior, the norms of morality. Efficient organization of authority of government and local authority, a purposeful formation of its bodies, strengthening the state discipline, reliable law enforcement and security give the opportunity to successfully overcome these antisocial manifestations. The Constitution of Ukraine embodies the right of local self-government bodies to independently carry out the protection of public order in subordinate to them territories. The Law of Ukraine «On local self-government in Ukraine» determines the issue of public order as the issue of local importance, and carries it to the number of issues under the local government. The legislative basis of local self-government, existing at the present time, does not allow full solving the problem of the delimitation of the powers of different levels of government, which prevents the efficient solution of a number of important issues of the activity of the local authorities, including the question of the implementation of the constitutional provisions on the possibility of giving local authorities separate state powers. Mentioned lack is reflected on their ability to participate in ensuring public safety.
