Система суб'єктів адміністративно-правового забезпечення суб'єктів господарювання в Україні

Abstract

Здійснено правовий аналіз розв’язання проблем пошуку вдалої та ефективної моделі системи суб’єктів адміністративно-правового забезпечення безпеки суб’єктів господарювання в Україні як окремого напрямку наукового дослідження. Зосереджено увагу на суб’єктах адміністративно-правового забезпечення, які здійснюють державну охоронну діяльність. Наведено спробу осмислення аспектів феномену недержавної правоохоронної й розшукової діяльності суб’єктів господарювання, оскільки, як свідчить зарубіжний досвід, саме їм має належати провідна роль у забезпеченні безпеки господарювання. The article deals with the legal analysis of solving the problems of finding a successful and effective model of the system of subjects of administrative and legal provision of security of economic entities in Ukraine. The author pays attention to the subjects of administrative and legal provision, carrying out state security activities. The group of domestic subjects of law enforcement includes: a) security enterprises; b) subjects of detective activities; c) security services of economic entities; d) public organizations of maintenance of public order and the state border; e) economic entities for which security activity is not basic; f) collection units of commercial banks; g) legal entities that provide collection services based on the license of the National Bank of Ukraine. Taking into account the classifications of the subjects of administrative law and the provisions of certain normative and legal acts, the classification of the subjects of administrative and legal provision of security of economic entities in Ukraine is proposed. The author divides them into two groups, one of which forms state subjects, and the other – non-state subjects. This separation covers differences in paraphernalia of administrative influence. In the context of the discussion of the subjects of law enforcement concerning their security and detective activities, a great attention is paid to the regional aspect. Today a comprehensive consideration of this aspect is not possible due to lack of proper information base, the investigation was restricted to determining the index of the number of entities in the region per one licensee of security activities, it gives some idea of its density. It seems logical hypothesis that increasing the maturity degree of security activities in the region contributes to its economic growth. It is necessary to consider a significant inverse correlative connection between the gross regional product per capita and the number of economic entities in the region per one licensee of security activities. In order to determine its strength, the correlation coefficient, which shows the presence of a significant negative correlative relationship, was calculated.
