Концепція розвитку державної контрольної діяльності

Abstract

Присвячено правовому аналізу наукових концепцій і форм реалізації в державі контрольної влади. Досліджено вагомість системи публічних контрольних інституцій для забезпечення ефективності функціонування сучасної демократичної держави. Розглянуто досвід країн Європейського Союзу у сфері організації та діяльності державного контролю. Встановлено, що невід’ємною складовою європейської держави є розгалужена система контрольних органів, ефективність діяльності яких залежить від рівня впровадження інформаційно-комунікаційних технологій. This article deals with the legal analysis of the scientific concepts and forms of realization of the state control authority. The validity of the system of public control institutions to ensure the effective functioning of a modern democratic state is investigated. The experience of the European Union in the organization and activity of the state control is considered. The extensive system of control bodies (the effectiveness of their activity depends on the implementation level of information and communication technologies) is an integral part of the European state. Control is a quite broad and voluminous legal category. It is considered as one way of ensuring the rule of law. It is not be limited to issues related to compliance with mandatory regulations – the laws and regulations, but it also checks the feasibility of the activity, includes adjusting actions. The efficiency of control in substantial degree is determined by the state of its theory. The situation is complicated by the fact that in terms of European integration the theory of control does not enter the existing methodological concepts. Control errors cause moral and material losses of the society. This directly relates to the state control. The presence of the concept of state control will help to build a system of the state control with its features within the theory of law. Improving the state control is one of the tasks facing the state in the context of the Association of Ukraine into the European Union. The concept of improving the state control activity in Ukraine provides for the centralization of all efforts in a single structure, which in this case should not create a hierarchy and accountability mechanisms in public control. The publicity of the state control can ensure fairness, legality and validity of measures of the state control. Information and communication technologies increasingly allows for transparency of the state control. The experience of the European Union concerning the use of information and communication technologies to improve the openness and accessibility of government shows that there are examples of successful use of information systems in the state control. These examples provide for the necessity of the establishment of the unified information system of the state control, which will collect the control information.
