Юридичні конструкції цивільного процесуального права: загальна характеристика

Abstract

Досліджено особливості використання юридичних конструкцій у цивільному процесуальному законодавстві. Проаналізовано юридичні конструкції цивільних процесуальних правовідносин, позову, цивільної процесуальної форми. На основі аналізу використання юридичних конструкцій у цивільному процесуальному законодавстві запропоновано зміни до законодавства. Підсумовано, що подальший аналіз використання в цивільному процесуальному праві юридичних конструкцій надасть змогу збільшити ефективність теоретичної та техніко-правової сторони правозастосовної діяльності. The article deals with specific features of using legal structures in civil procedural law. It analyses the legal structures of civil legal procedural relations, claims and civil procedural form. Changes to the law are proposed based on the analysis of the use of the legal structures in civil procedural law. It is noted that there is a constantly increasing number of structures of law which explains the consideration of issues related to the essence, nature and value of legal structures in legislative practice of Ukraine. Industry law is subjected to a variety of structures which are studied by industry juridical sciences taking into account the subject of the study. Features oflegal structures in civil procedural law are determined by their focus on optimizing civil procedural justice, implementation of the objectives and goals of justice, that is fair, impartial and timely consideration and resolution of civil cases for the protection of violated, unrecognized or disputed rights, freedoms or interests of individuals, rights and interests of legal entities, and interests of the state. The article analyses legal structures as perfect generalizing statutory models of the structure of legal phenomena created to generate regulatory, security, protective legal and statutory requirements and achieve accuracy and clarity of laws and specific features of their use in civil procedural law. A legal structure has a specific feature which is caused by specifics of the area of law to which it is applied. In every field of law, there are invariable structures, whose state and development form a key indicator of the excellence of this field of law, its level of development. Further detailed analysis of legal structures and their use in civil procedural law will increase the effectiveness of theoretical, technical and legal aspects of administration of law and will allow for full-fledged theoretical research in this field.
