Ефективність правової політики як показник життєздатності суспільства

Abstract

Розглянуто ефективність правової політики як показник життєдіяльності суспільства, яке визначає міру можливого впливу системи правових явищ на становлення, регулювання й розвиток суспільних відносин. Між системою права і соціальними результатами її дії завжди є акти людської діяльності, які зумовлюють суспільно значущі наслідки. Окреслено, що на поведінку людей правова політика впливає не тільки безпосередньо, але і через систему соціальних, особистих, психологічних чинників, які діють на індивідів одночасно зі системою права та системою законодавства. The national legal policy sets the internal and external objectives for the development of our country. It is proved that the legal policy of Ukraine should be based on the implementation of the international legal standards, generally accepted constitutional principles and national values, democratic institutions into the strategy of the country development. At the same time, it is important to take into account the opinion of the population of the country, its legal culture and legal consciousness. In future, this legal policy will promote increasing the level of trust to statutory authority and the optimal achievement of declared political goals. Universally recognized legal heritage of civilized nations should be the basis of the formation of legal policy of the modern Ukrainian State. The process of legal policy must be purposive, and its development is carried out by raising the quality of existing standards, strengthening their social impact. Improvement of legal policy is closely connected with the process of the improvement of legal regulation, state and powerful, political and constitutional, economic and social development. Its efficiency can be evaluated with legal usefulness of achieved results. In general, the efficiency of the legal policy is one of the indicators of the viability of the society that defines the measure of the possible influence of the system of legal phenomena on the establishment, regulation and the development of public relations. There are always the acts of human activity between the law system and its social results. They predetermine socially meaningful consequences. Under such conditions, the efficiency of the legal policy is the efficiency of the law system and its consequences. Moreover, the legal policy affects the behavior of people not only directly, but also through a system of social, personal, psychological factors acting on individuals simultaneously with the law system and the legislation system.
