Abstract: Досліджено механізм забезпечення вимог кредиторів як сторін у справі про банкрутство і захист їхніх майнових інтересів, з метою створення подальших необхідних умов для відновлення фінансового становища боржника і збереження його майнових активів із застосуванням системи заходів із нагляду та контролю в судовій процедурі розпорядження майном боржника. Проаналізовано та виокремлено ефективні заходи забезпечення вимог кредиторів й обґрунтовано доцільність способів їх законодавчого удосконалення, що забезпечить реальне й ефективне розпорядження майном боржника. The article is dedicated to the research of the mechanism of the guaranteeing of creditors’ claims and the defense of their property interests as one of the sides in the bankruptcy court case with the aim of creation of further necessary conditions for the restoration of debtor’s financial stability and the preservation of debtor’s property assets with the help of supervision and control measures during the court trial. The analysis and differentiation of the effective measures of the guaranteeing of creditors’ claims and justification of advisable ways of their perfection will ensure the effective disposition of debtor’s assets. The creation of necessary conditions for the restoration of debtor’s financial stability with the preservation of his property assets is possible only with the effective legal regulations. The analysis of the existing law and its practical application particularly gives reasons for understanding the necessity of the amendments of the bankruptcy trial procedures as the main mechanism of the restoration of debtor’s solvency and the satisfaction of creditors’ claims which will decrease the possibility of occurrence of practical bankruptcy-related problems which unconscionable debtors and some creditors exploit to redistribute the property assets, to start raiding, or to avoid payment. The legislation that regulates the disposition of debtor’s property during the bankruptcy court procedure does not provide the necessary conditions for the protection of property interests of unsecured, secured, and preferred creditors; and as for the debtors, even with the help of supervision and control measures, it does not crate legal grounds for further restoration of debtor’s solvency which in its turn generally affects the country’s economy. The theoretical basis of the study constitutes of the works of the domestic and foreign researchers in the fields of economical law, civil law, civil procedural law, and economical procedural law, in particular N. V. Asyeyeva, R. H. Afa-nas’yeva, A. A. Butyrs’kyy, O. M. Biryukov, I. O. Vechirko, V. V. Junya, S. M. Hrud-nyts’ka, H. F. Shershenevych, S. V. Min’kovs’kyy, B. M. Polyakova, P. D. Pryhuza, M. I. Titova, V. V. Padzyvylyuk, and others. The aim of the study is an in-depth analysis of the mechanism of guaranteeing of creditors’ claims and their property interests in judicial proceedings.
