Основні принципи діяльності поліції щодо забезпечення конституційних прав і свобод людини та громадянина в Україні

Abstract

Досліджено принципи діяльності поліції щодо забезпечення конституційних прав і свобод людини та громадянина в Україні. Проаналізовано юридичну сутність принципів діяльності поліції у контексті Закону України «Про Національну поліцію». Розглянуто класифікацію принципів діяльності поліції та вплив на стан захищеності прав і свобод людини у період реформування правоохоронної системи держави. Constitutional rights and freedoms are normative and doctrinal values fixed in the Constitution, guaranteed by the State, that provide every person and citizen equal opportunities to choose freely and independently the type and measure of his/her conduct in accordance with their abilities and interests. The analysis of the police activity to ensure the constitutional rights and freedoms of man and citizen in their system has a direct practical sense. First, with all the variety of the rights and freedoms it allows adequately reveal their unity, inner content, interdependence, role in social processes, values in the satisfaction of vital needs and interests of every man and of the citizen in the context of the activities of the police. Secondly, the police activity to ensure the constitutional rights and freedoms of man and citizen is not artificially abstracted from other types of law enforcement, but allows you to analyze the features of the police activity, to identify patterns of the legal embodying of principles. Thirdly, the study of principles is important for comprehensive development of issues for their implementation, specificity and efficiency of implementation. The police activity in the legal mechanism of ensuring the constitutional rights and freedoms of man and citizen is hard to overestimate. Police serve the actual use of person’s rights and freedoms, strengthening and mutually reinforcing each other. The tasks, functions, measures and procedures for their implementation concern almost all citizens; determine the volume of communications, relations between the police and the people through a system of principles. This is evidence that the police in volume, diversity of regulatory, supervisory, licensing and warning functions are the most differentiated instrument of State power and one of the most important elements of a legal mechanism to ensure the constitutional rights and freedoms of man and citizen of Ukraine. In the legal mechanism of ensuring the constitutional rights and freedoms, the principles of police activity represent a comprehensive, integrated, comprehensive and multilevel system of elements.
