Деякі проблемні питання злочинів, учинених на ґрунті нетерпимості

Abstract

Досліджено проблеми ксенофобії в українському суспільстві. Зауважено, що злочини, учинені на ґрунті нетерпимості, характеризуються певними особливостями, а саме появою порівняно нових мотивів для ксенофобних настроїв. Основну відповідальність за боротьбу зі злочинами на ґрунті ненависті покладають на державу. Для організації ефективного попередження аналізованих злочинів дуже необхідними є підвищення рівня обізнаності, проведення навчання і підготовки працівників органів та підрозділів Національної поліції щодо виявлення, розслідування та попередження злочинних виявів на ґрунті нетерпимості. The article deals with investigating the problems of xenophobia in the Ukrainian society, namely crimes committed on the base of national, racial, religious and ethnic intolerance. It is proved that specific features characterize crimes on the ground of intolerance: the emergence of new motives for xenophobia moods – linguistic and territorial; the reason for the hostile attitude is not a race and ethnic origin of the object of enmity, the reason is his language of communication, or place of residence. These criminal manifestations are particularly cruel, and therefore they pose a serious threat both to victims and to the whole society. The main responsibility for fighting crime on the base of intolerance relies on the state. Employees of the agencies and units of the National police, as representatives of the state, are often the first professionals arriving at the crime scene. However, insufficient training for detection and investigation of hate crimes can lead to their inability to identify the offence on the base of hatred in a proper way, to collect evidence of the motivation and/or to carry out reporting requirements. For effective prevention of crimes, it is necessary to increase awareness, educating and training of workers of bodies and units of the National police for detection, investigation and prevention of criminal manifestations on the ground of intolerance. There are many reasons for the increase in the number of crimes committed on the base of intolerance in our country. They include the growth of social and economic problems in the society, the ineffectiveness of the preventing policy of appropriate phenomena in general and in the youth environment in particular.
