Державно-правовий механізм забезпечення національної безпеки

Abstract

Порушено питання державно-правового механізму забезпечення національної безпеки. Розглянуто функції державно-правового механізму забезпечення національної безпеки, які залежать від характеру масштабів і ступеня реальних і потенційних загроз у політичній, економічній, соціальній сферах. Розкрито соціальну природу державно-правового механізму забезпечення національної безпеки, яка зумовлена об’єктивними історичними процесами кооперації та організації соціальної діяльності. Nowadays the problem of providing national security is of great importance for Ukraine. The dramatic geopolitical changes of the last decade radically transformed the entire organization of international relations created after World War II, moreover – formed for all time of human civilization. The conditions for the existence and development of our country have changed fundamentally; threats to the security of Ukraine have changed too. According to this situation tasks of timely detection, prevention and elimination of threats are changing now. Ensuring safe conditions and development of the country, which is considered in the relationship and interdependence with the internal situation in the country, with emerging challenges and opportunities of their solving form the fundamental task of the state, and its continuous solution is providing national security. In terms of political and legal organization the security system takes a specific form, but it doesn’t change its nature. The state, its institutions and bodies become the most effective means of counteraction to internal and external threats of the social, natural and technogenic character. Due to constant changes of the internal and external environment the state and society have always tried to develop effective means of protection against relevant threats. This problem is useful under global civilizational changes. The article deals with the public and legal mechanism of providing national security. The functions of public and legal mechanism of providing national security which depend on the nature and degree of the actual and potential threats in the political, economic and social spheres are studied. The social nature of the public and legal mechanism of ensuring national security, which is caused by objective historical processes of cooperation and organization of social activity, is revealed.
