Щодо неоднозначного тлумачення застосування деяких норм і положень Закону України "Про оперативно-розшукову діяльність"

Abstract

Досліджено суперечливі положення норм Закону України «Про опера-тивно-розшукову діяльність» щодо принципів оперативно-розшукової діяль- ності, посилань на чинний Кримінальний процесуальний кодекс України, мети пошукової діяльності оперативних підрозділів органів внутрішніх справ, що призводять до неоднозначного трактування правозастосування заходів оперативно-розшукової діяльності. Акцентовано на необхідності законодавчого визначення поняття та змісту оперативно-розшукових заходів, поняття, змісту та переліку заходів оперативного пошуку з метою виконання конкретних завдань оперативно-розшукової діяльності до початку оперативної розробки за оперативно-розшуковою справою. Contradictory positions of norms of Law of Ukraine are investigated «About operational search activity» in relation to principles of operational search activity, references to the operating Criminal code of practice of Ukraine, aim of realization of searching activity by operative subdivisions of organs of internal affairs that result in ambiguous interpretation legal application measures of operational search activity. The select range of problems of improvement of the normatively- legal providing of operational search activity continues to be a near-term task for scientists and practical workers of law-enforcement sphere. The analysis of the normatively-legal providing of operational search activity of organs of internal affairs of Ukraine allows to establish, that realization of tasks of operational search activity, essentially, takes place by application of measures of operative search and operational search measures with the use of operative and operational and technical facilities. Attention is accented, that operational search activity does not behave to none of the stages of criminal realization, and consequently not regulated by the norms of the Criminal code of practice of Ukraine. Grounded, that in text of Law of Ukraine «About operational search activity» it is necessary clearly to write the special principles of operational search activity, namely: secrecy, confidentiality, purposefulness, offensiveness, combination of vowel and secret measures in counteraction to criminality, are the implementations of her tasks conditioned by a necessity before society in the field of a fight against criminality; clearly to define a concept and maintenance of operational search measures; separately to prescribe the vowel measures of searching activity, that can be used the employees of operative subdivisions subjects of operational search activity with the aim of implementation of the same tasks of operational search activity, as in absolute majority of cases the results of operative search become grounds for the beginning of operative development after an operational search саses.
