Abstract

Викладено узагальнення щодо філософсько-правової оцінки проявів корупції, її тенденцій, що є характерними для процесів право- та державотворення, розглянуто питання соціально-економічних та індивідуально-правових наслідків корупції в онтологічному та деонтологічному аспектах. Здійснено об’єктивний правовий аналіз явища корупції, що дає можливість констатувати фактичну легалізацію корупційних діянь як системотворчого функціонального базису державного апарату Японії у період ХІІІ–ХVІІ ст.ст. Визначено, що корупція – поліаспектне явище, яке перебуває у нероздільній взаємодії з іманентним психоемоційним середовищем індивіда: виникає внаслідок функціональної атрофації внутрішнього імперативу державного службовця та водночас збільшує інтенсивність подальших негативних трансформацій останнього. In this article the generalizations on historical estimates of corruption trends that represent state of legal sphere, addresses the individual, social and economic consequences of corruption in society has been analyzed and the basic direction of counteraction to this negative phenomenon were underlined. An objective legal analysis of the phenomenon of corruption, which makes it possible to ascertain the actual legalization of corruption as the backbone of the state apparatus functional basis in Japan during the 13–17 century has been made. It was underlined that corruption was multi aspect phenomenon, which has been formed by a collaboration with undivided immanent psycho-emotional environment of the individual, resulting from destruction of internal function of public officer and at the same time increases the intensity of further negative transformation of the very person. The characteristics of the social and legal life of Japan were determined by the domination of philosophical and religious spheres over traditional form so modern states governance that ensure proper implementation of control measures in modern society – law, stratification of political forces, preventive and repressive components of the law. The function of system-building concept of the social system of Japan was performed by a caste model of society with clear and axiomatic differentiation of potential of each of the five castes in the aspect of use of the social benefits. It was underlined that duet the low level of specialization of the law as a complex of social institute, the appearance of corruption in the sources of social-politic knowledge of the ancient period is projected through the very foundation of the society itself, so we marked up the essential is of different social real consolidate corruption as it has been percepted by the representative of the very period. An effort to produce the specific comparative-function analysis is of the forms and the very understanding of corruption in the antic and modern periods of legal sphere development were made.
