Конституційно-процесуальна відповідальність народного депутата України за невиконання або неналежне виконання обов'язків у парламенті

Abstract

Досліджено деякі теоретично-правові аспекти конституційно-процесуальної відповідальності народного депутата України за невиконання (неналежне виконання) функцій і повноважень у парламенті як однієї з найважливіших гарантій конституційного процесу. Адже реалізація ідеї становлення в нашій державі демократії, парламентаризму та громадянського суспільства практично неможлива без наявності відповідальної центральної влади. Зауважено, що активні процеси розвитку українських політико-правових явищ спричиняють зосередження особливої уваги нашого суспільства та міжнародної спільноти на становленні та укріпленні інститутів відповідальності парламентарів. Theoretical and legal aspects of constitutional procedural responsibility of people’s deputy of Ukraine for non-fulfillment of the functions and powers in the Parliament are examined in the article. The question of the independence of constitutional and procedural responsibility is new to science, although the question of the constitutional responsibility of government entities have been raised by scientists, particularly in the following areas: qualification as a sign of constitutional law or specific problems related to the implementation and provisions of the effectiveness of constitutional and legal norms; the correlation of the constitutional and political responsibility. The necessity for the development of new theoretical, constitutional and legal structures for the implementation of constitutional and procedural responsibility of elected national representatives in the Ukrainian legal system. The concept of constitutional and procedural responsibility, grounds, range of subjects, procedures for prosecution and the imposition and execution of sanctions, the implementation of preventive measures may be concluded in the Constitutional Procedural Code, passed by the parliament after a general discussion and approval of the members of the constitutional process, leading academic institutions, judicial and law enforcement authorities and society. Without proper protection of the constitutional process by the state and in the absence of proper provision of its members lawful behavior, without fixing constitutional and procedural responsibility at the highest legal level the country may face the problems connected with the implementation of the legal, political and other norms, defining the type of responsibility and imposing sanctions on the offender in the sphere of political and legal (constitutional and procedural) relations that in today’s conditions often results in the violation of the principles of justice and inevitability of punishment of the offender, who represents a particular branch of the government.
