Правове підгрунтя забезпечення права на свободу мирних зібрань у Польщі та Україні

Abstract

Розглянуто реалізацію права на мирні зібрання громадянами Польщі, його правове підґрунтя, правомірність спонтанних зібрань, необхідність повідомлення місцевої влади про проведення мирних зібрань, а також відповідальність за проведення несанкціонованих мирних зібрань. Визначено правові межі допустимості втручання влади у реалізацію права громадян на мирні зібрання і у Польщі, і в Україні та ступінь законодавчого врегулювання цього права відповідно до європейських стандартів забезпечення прав людини. Realization of the right to peaceful demonstrations by citizens of Poland, its legal basis, the legality of spontaneous demonstrations, necessity of informing local authorities about holding peaceful demonstrations and responsibility for unauthorized peaceful demonstrations are analyzed in the article. Legal limits of acceptability government interference with the human rights to peaceful demonstrations in Poland and Ukraine and the degree of legislative regulation of this law according to the European standards of human rights are defined. Art. 57 of the Constitution Poland guarantees every citizen the freedom to organize peaceful assemblies and participating in them. Limitations of this right is only possible because of the new law, and only when it threatens public safety, public order, environmental protection, public morality and freedom, the rights of others people. The legal basis is clear, but the law of Poland on peaceful demonstrations was legislate in 1990, and the development of society and the processes of globalization both in Poland and in Europe and the world require changes in legislation. At that moment not all possibilities for citizens about organization and holding peaceful demonstrations are provided in the law. The reason is spontaneous demonstrations for each realazation participants cfn not inform local authorities. In Ukraine only in art. 39 of the Constitution of Ukraine the right of citizens to peaceful demonstrations is established. This right of Ukrainian people that provides in Constitution is directly applicable, unconditional and does not require additional regulations. This right is provided, but the mechanism of its implementation in no way settled. Informing the local authorities about holding a peaceful assembly is regulated in Ukraine on the level of the Constitutional Court on 19 April 2001.
