Правова поведінка як вид соціального замовлення

Abstract

На основі аналізу концепту «соціальне замовлення» розглянуто правову поведінку як один із видів цього замовлення, під яким розуміється законодавство та право загалом. Протиправну поведінку також описано у соціальному замовленні (праві) як небажаний або заборонений тип, якого слід уникати і не уникнення якого не просто ігнорується суспільством, а відповідно карається. Водночас соціальне замовлення, послуговуючись засобами людського мислення, формує у соціального суб’єкта певні образи бажаної або необхідної поведінки, які через значущість для суспільства стають своєрідними правовими знаками. A person builds his vital activity in the context of the so-called «social order», that is he operates in the way the society needs or even demands. It sets the requirements to the conduct of a social entity in the form of rules and regulations and, therefore, requires their fulfillment and compliance. «Social order» of human behavior implies endorsement, support, recognition just in the case of justification of the expected result – the production of certain (listed in «order») actions and deeds. Thus, each individual society formulates its «ordered» types of behavior, recognizing them admissible, acceptable or desirable within its borders. The history knows various versions of social order of a certain type of behavior or even of specific actions. The author gives examples of ancient Egyptian mourners and clappers hiring together with the use of halo effect, overcoming of social cognitive dissonance (sensation of lack of harmony, social discomfort) and the fundamental attribution error (influence of false visual perception on further behavior). On the basis of the concept of «social order» a legal behavior is considered as one of the types of this order, which refers to the legislation and law in general. Illegal behavior is also described in the social order (law) as undesirable or prohibited type, which should be avoided and the attempt to unavoide should not be simply ignored by the society but must be punished. Thus, the social order, employing the means of human thought, creates inside the social entity certain images of desired or necessary type of behavior that due to its importance for the society become specific legal signs. The above-mentioned factors of social order, particularly with regard to legal behavior, display problematic aspects of its formation (through justice), set tasks (create legal images) and offer ways to implement them (within the legal reality).
