Ціннісний аспект підвищення ефективності адміністративно-правового регулювання

Abstract

Розглянуто питання підвищення ефективності нормативно-правового регулювання у зв՚язку з адаптацією національного адміністративного законодавства до вимог Європейського Союзу з використанням аксіологічного підходу під час дослідження нормативно-правових явищ. Проаналізовано цінність норми права, її вплив на ефективність правового регулювання адміністративно-правової сфери з позиції складноорганізованої сукупності цінностей, на підставі яких встановлюють систему прав і обов՚язків. The article deals with the theoretical approaches to defining ways of increasing the efficiency of the administrative and legal regulation in the context of social changes in Ukraine. Effective legal regulation is one of the main conditions for a stable and consistent development of Ukrainian society, its economic and social foundations. Taking this into account, it becomes clear the urgent need for studying axiological conditionality of improving regulatory function of law and ability to influence the interaction process of legal and valuable components of human consciousness that largely reflect the effectiveness of regulation. The development of legal theory and practice is resolved with the help of values and legal outlook of legislators, officials, and citizens.With the transformation of law under the influence of normative adaptive processes on the functioning of the social system according to the European legal traditions of legal culture and legal values, the Revolution of dignity, a new picture of legal validity is forming. Changing fundamentals of the regulatory system lead to the transformation of rules. There are special techniques to determine the effectiveness of the methodological study. The study of the effectiveness of regulation should be carried out on the basis of knowledge that law is a general phenomenon. The efficiency of standards is grounded on the legal means used in the system of social regulation. The starting point for the characteristics of effective administrative control should be proper analysis of the specific legal means used for regulation of social relations. Some limitations, objective system of legal tools, influence on social relations create limits of the efficiency of legal regulation, although they do not alter the fundamental nature of the potential mobility of legal regulation.
