Щодо використання окремих юридичних термінів у нормах поліцейського права

Abstract

Проаналізовано юридичні терміни, які використовуються у теорії та практиці поліцейської діяльності в Україні. Зокрема розглянуто доцільність застосування таких понять, як «органи внутрішніх справ» та «публічний порядок». Проведено дослідження норм Закону України «Про Національну поліцію» в частині регламентації повноважень поліцейських щодо застосування ними поліцейських заходів. Відтак запропоновано внести зміни до цього закону, які обґрунтовано теоретичними положеннями класифікації заходів адміністративного примусу. The police function of the state has been investigated for a long time. Even without the awareness of the scientific terminology, this function was provided in any society where there were power relations, and where it was necessary to ensure order, which norms were determined by the subject vested with the competent authority, at his discretion. However, today the legislation requires a coherent approach to the use of legal terms in all normative and legal acts, which regulate a special sphere of legal regulation, in particular, a sphere of police activity. With the adoption of Law of Ukraine «On the National Police» it is necessary to analyze legal norms for establishing the compliance of special legal terms used in this law with other regulatory acts and theoretical provisions of Police law. The analysis of legal terms used in the theory and practice of police activity in Ukraine is made. In particular, the appropriateness of the use of such terms as «bodies of internal affairs» and «public order» is considered. The study of the norms of Law of Ukraine «On the National Police» in the part of regulation of the police powers and application of police measures is carried out. It is proposed to make changes in the Law that are substantiated by theoretical provisions of the classification of the measures of administrative enforcement. Therefore, the adoption ofLaw of Ukraine «On the National Police» begins the newest stage of the formation of general police in our country. The changes in the philosophy of law enforcement, the desire to achieve European standards of police activities include a significant amount of rule-making work. Such work should involve not only the desire to introduce new terminology into legal circulation, but also the coordination of the relevant terms with the existing legislative acts and with scientific and reasonable theoretical provisions.
