Реалізація морально-правового принципу справедливості у службовій діяльності працівників ОВС України - шлях до європейської моделі поліції

Abstract

Розглянуто проблему справедливості та її роль у службово-професійній діяльності міліції (поліції). Зауважено, що справедливість – ключове поняття у формуванні нового філософського світогляду, стосовно ролі та місця правоохоронних органів у провідних демократичних державах світу, а також процесів, які тривають в Україні: демократизації та реформування правоохоронної системи, що спрямовані на відповідність європейським стандартам захисту прав і свобод людини і громадянина у службовій діяльності української міліції. The problem of justice and its role in the service and professional activities of militia (police) is examined in the article. The problem of justice is exceptionally complicated and multifaceted and, as a rule, concerns interests, dignity and, some-times, even life of an individual. The wise men of the antiquity linked this category closely with the law and justice. The principle of justice is one of the fundamental principles in the entire system of legal relations. The problem of justice is closely connected with the priority of general hu-man values and, especially, observance by the law enforcement officers of human rights and freedoms. Observance of the principles of justice requires from the law enforcement of-ficer (LEO) to keep to the principles of morality and the rule of law. This means, that sometimes the fate of an individual, his dignity, honor will depend on the law enforcement officer, his professional skills and moral qualities. Thus, under such conditions, the concept of justice arises not only as a so-cial-philosophical, but also as an ethical-legal problem. Justice as a general human value, a guarantee and index of legal protection of an individual and a citizen is based on the international-legal acts. Of special importance are the international normative legal acts that formulate requirements to the official-professional activity of the police of foreign countries. These studies make a stress on the formation of humanistic relations be-tween citizens and the police, on the responsibility for protection of human rights, freedoms, honor and dignity. The legal-moral principles of the professional activity are lawfulness and justice, service for the benefit of the law and a man. It should be noted, that the no-tion of «justice» for the police officers is associated with such categories as lawful-ness, conscience, honor, dignity and responsibility. Strictly observing the principle of justice, a law enforcement officer in his/her work must always remember, that in accordance with the Constitution of Ukraine the man and his life and health, honor and dignity, immunity and security are regarded in Ukraine as the supreme social value.
