Акти Кабінету Міністрів України системі джерел адміністративного права України

Abstract

Проаналізовано акти Кабінету Міністрів України у системі джерел адміністративного права та нормативно-правових актів України. Враховую-чи, що юридична чинність підзаконних нормативних актів залежить від становища органів держави, які видають ці акти, їх компетенції, а також характеру і призначення актів, нормативно-правові акти Кабінету Міністрів України посідають чільне місце серед актів інших органів виконавчої влади, маючи серед них найбільшу юридичну силу. The article analyzes the place of acts of the Cabinet of Ministers of Ukraine in the system of sources of administrative law and analyzes the place of acts of the Cabinet of Ministers of Ukraine in the system of sources of administrative law and regulatory legal - normative acts of Ukraine. Concerning the changes that occur in the system of legal normative acts and their impact on the place of acts of the government as relevant today it should be mentioned the importance of them for theory and for practice and place of legal normative acts of the government, the Cabinet of Ministers of Ukraine, determined by the Constitution of Ukraine. It establishes that the decision on its validity below the Constitution and laws of Ukraine, decrees of the President of Ukraine, however, above all other acts of Executive authorities, which is associated with the following regulations of the Cabinet of Ministers of Ukraine constitute the largest group of sources of adminis-trative law in the part, which expressed the norms of administrative law (although, of course, that the acts of the Government are sources and other branches of law – constitutional, financial, estate, etc.). Legal normative acts of the government in Ukraine are of a secondary na-ture, but the validity is higher than other acts of the executive authorities. Given that the legal force of regulations depends on the position of the authorities of the state issuing these acts, their competence, and the nature and purpose themselves acts, normative legal acts of the Cabinet of Ministers of Ukraine takes a prominent place in the midst of acts of other bodies of the executive power, having the greatest legal force. The acts of all other bodies of the executive power in the hierarchy of legal acts are below the acts of the government and shall comply with them. At the same time still acting decrees of the Cabinet of Ministers of Ukraine have the force of law and may be modified or cancelled only in a legislative manner since been taken under delegated authority.
