Abstract

З’ясовано засадничі природно-правові ідеї відомого вченого Бориса Миколайовича Чичеріна. Проаналізовано його ґрунтовну філософсько-правову працю «Філософія права», яка розкриває первинні ідеї утворення та формування філософіїправа у вітчизняній науці. Висвітлено авторський погляд на філософсько-правові явища тогочасного суспільства та державності, що дає змогу усвідомити певні правові моделі співіснування різних явищ у розвитку держави. Зауважено, що домінуюче значення у становленні та функціонуванні нашого суспільства повинні мати природні та правові підвалини у процесі регулювання суспільних відносин. The article is sanctified to research of fundamental naturally-legal ideas of well-known scientific Boris Nikolaevich Chicherin and his sound philosophical-legal labour «Philosophy of law», that exposes the primary ideas of education and forming of philosophy of law on walks of life of home science. Characterized the author's vision of the philosophical-legal phenomena of contemporary society and statehood, which allows the realization of certain legal models of coexistence of different persons in the development of the state. Dominant role in the formation and development of our society must be natural to the legal framework in the process of public relations. For a scientist conception was unacceptable in accordance with the that only border of freedom there is freedom of other man. In connection with this individualistic point of view of thinker a law can forbid only what a damage can inflict other. But alas such order not only proves to be correct neither history nor speculation, but simply unthinkable in the real life. Examining nature offreedom of B.N. Chicherin saw in beginning equality all before a law that can be only the formal condition of civil liberty. The table of contents of her were those different rights that followed from her as necessary consequences. For a scientist remained an axiom that any man has rights, as on the nature she is free personality. Inheritance of scientist and his «Philosophy of law» served beginning of revival of absolute law and was highly valued by many scientists.
