Ефективність реалізації кримінально-правових норм охорони економіки України

Abstract

Зауважено, що в економічному і соціальному житті України з часу здобуття незалежності спостерігається безперервний процес змін, спрямований на наближення окреслених сфер до європейських стандартів. Ці перетворення спричинили необхідність удосконалення вітчизняного законодавства та його гармонізації з потребами сьогодення. Окреслене твердження набуває особливого значення у протидії злочинам у сфері економіки, оскільки вказані злочинні посягання заподіюють шкоду не лише економіці України, а й добробуту населення загалом. Зазначено, що визначення ефективності реалізації кримінально-правових норм охорони розглядуваної сфери вкаже на правові прогалини та способи їх подальшого усунення. Under modern conditions the problem of economic security of a person and a state, becomes the basis of the entire economic policy as well as the most important characteristic of quality of life and state of the economy. A high level of economic security leads to the conclusion of welfare and security of population, proper development of society and the state in general. Therefore, an effective counteraction and protection of the state and population from criminal encroachments of economic nature is the main task of public authorities intended to supervise and control the legality of activities in the economy, the implementation of public programs, regulations, orders, and instructions aimed at overcoming the criminality. In turn, in order to counteract the aforementioned negative phenomenon the legislator has provided a number of criminal and legal standards, whose purpose is to provide legal protection of citizens from criminal encroachments as well as prevention of their manifestation. At the same time, the Criminal Code of Ukraine determines which publicly dangerous crimes are and which punishments are applied to the persons who have committed them. Therefore, criminal and legal protection of economy of Ukraine is carried out due to certain standards, determined by the legislator, that envisage criminal responsibility for committing crimes in a particular area. Furthermore, scholars conduct research work on improvement of legislative provisions in the area of economic relations. However, despite the urgency of the issue, the researchers still have not formed a consensus on the establishment of the efficiency of criminal and legal standards of protection of the the economy of Ukraine. Therefore, it seems insufficient to focus exclusively on the theoretical basis that requires the need to broaden the scope of scientific research and the study not only the current legislation, as well as its applications by the courts and penitentiary institutions. Our investigation will provide an opportunity to determine the efficiency of current criminal and legal standards of protection of the economy of Ukraine and obtaining results will indicate legal loopholes for their further elimination.
