Передумови та міжнародно-правові особливості встановлення кордону між Румунією та Радянським Союзом після Другої світової війни

Abstract

Розглянуто міжнародно-правові засади встановлення післявоєнного (1945 р.) радянсько-румунського кордону, а також вплив фактора військових зусиль сторін на зазначені процеси. Проаналізовано передумови для остаточного визначення післявоєнного кордону відповідно до міжнародно-правових норм того часу. Вказано об’єктивні причини, які зумовили проведення остаточної лінії кордону між Румунією та Радянським Союзом, котра визначає розмежування територій України та Румунії до нині. We consider the international legal principles ofestablishing postwar (1945) SovietRomanian border and the impact factor ofmilitary efforts of the parties on this process. The prerequisites for the final determination ofthe post-war borders in accordance with international law of the time are analyzed. The objective reasons which led to holding the final boundary line between Romania and the Soviet Union, which defines the separation ofthe territories of Ukraine and Romania to present time are identified. Post-war borders in Eastern and South-Eastern Europe are seen as the result of the Soviet dictatorship, their international legal validity is questioned. On the other hand, Moscow is often accused ofallegedly inadequate protection of the interests of so-called Indigenous Peoples of the USSR – Ukrainian, Belarusians, Moldovans. To be determined how justified this kind of charge, whether or not the post-war Soviet border was determined solely by the will of one man in the Kremlin. Could postwar Soviet-Romanian border pass in other geographical latitudes, and why in 1947 more Soviet territorial claims (Snake Island, a total area of 20.5 ha) were very moderate.
