Принцип єдності прав і обов’язків у сфері охорони довкілля як основа еколого-правового статусу людини та громадянина

Abstract

З’ясовано поняття і сутність суб’єктивних прав та юридичних обов’язків людини у сфері охорони довкілля, а також принцип їх єдності як основи еколого-правового статусу громадянина. Проаналізовано характер взаємозв’язку екологічних прав та обов’язків, установлених чинним законодавством України та міжнародними договорами. Констатовано, що від правильності розуміння співвідношення прав і обов’язків у сфері охорони довкілля залежить правомірна екологічна поведінка людини, повне використання прав і неухильне виконання обов’язків перед природою, теперішнім і майбутніми поколіннями. The article investigates the concepts and subjective nature of human rights and legal responsibilities in environmental protection, as well as the principle of unity as the basis ofenvironmental legal status of citizens. Author examined features of constitutional environmental rights and responsibilities as important components of a specific legal status and the central element of its environmental legal status. Analyzed the legal nature, content, features, structure of rights and duties human and citizens in the field of environmental protection and their constitutional and legal regulations in Ukraine. The classification of these rights and responsibilities, analyzes the conditions and factors that influence their implementation. Еmphasizes that environmental law environmental liability with a corresponding constitutional because they serve an important structural element of the environmental legal person status, a form of social relationship and personal interest in environmental management, a means of coordinating behavior in relationship with nature. Environmental duty is one way to ensure environmental rights, the condition of their reality and effectiveness. Analyzes the nature of the relationship of environmental rights and responsibilities established by the current legislation of Ukraine and international conventions. It is noted that on the correct understanding of the relationship of rights and duties in environmental protection depends legitimate environmental, human behavior, full use of the rights and duties to the strict nature of present and future generations.
