Abstract: Розглянуто правовий статус експерта у цивільному судочинстві. Досліджено правове регулювання повноважень експерта, виявлено прогалини та недоліки в ньому. Законодавчі положення проілюстровано прикладами з судової практики. Сформульовано зміни до ЦПК України, які б зміцнили гарантії учасників процесу щодо реального захисту (поновлення) їхніх прав. The article considers the legal status of an expert in civil proceedings. Under the Civil Procedural Code of Ukraine an expert is a person entrusted to conduct study of tangible objects, phenomena and processes that contain information about the circumstances of the case and give opinion on issues that arise during the proceedings and related to areas of special knowledge. A person who meets the requirements established by the Law of Ukraine «On legal expertise» and is included in the State Register of certified court experts may be involved in case as an expert. The authors investigate the legal regulation of expert’s powers (the expert is entitled to get acquainted with case materials related to the subject of research, to appeal a petition on submission of additional materials and specimens to him/her, to develop in the conclusion of legal expertise the facts relevant to the case and revealed during its implementation, he had not been posed question of, to be present during the commitment of proceedings relating to the subject nd object of examination, to pose questions to the persons involved in the case and witnesses, to use other rights established by the Law of Ukraine «On legal expertise», to be paid for the work and get reimbursement of expenses related with the examination and summon to court; an expert may refuse to give opinion, if he was submitted materials insufficient to carry out its duties), and detect gaps and faults in it. Legislative provisions are illustrated by examples from judicial practice. Amendments to the Civil Procedural Code of Ukraine, which would strengthen guarantees for participants of civil process in practicable protection (rehabilitation) of their rights, are formulated.
