Забезпечення охорони громадського порядку правоохоронними органами під час виборів і референдуму

Abstract

Розглянуто питання щодо забезпечення охорони громадського порядку правоохоронними органами під час виборів і референдуму. Проаналізовано правоохоронний правовий режим забезпечення громадського порядку під час виборів і референдуму як особливий порядок законодавчого врегулювання діяльності, дій або поведінки фізичних та юридичних осіб у різних сферах суспільних відносин або на певних об’єктах (наприклад, на виборчих дільницях), що охоплює встановлення механізму забезпечення фактичної реалізації системи дозволів, стимулів, нормативів, гарантій, заборон, обмежень, зобов’язань. Розкрито особливості механізму адміністративно-правового регулювання суспільних відносин у сфері охорони громадського порядку. The most important and effective way of expressing and raising the will of the nation is the right to free elections, which can be considered as a basic political right of citizens and general suffrage is a priority, that is – suffrage is important not in itself but as a means of implementing the political interests of the citizens and their public associations. Ensuring free elections in the State authorities determines the state of development of all structural elements of the electoral process, first and foremost is the maintenance of public order. The maintenance of public order during the elections in Ukraine is aimed at preventing the dangers where law enforcement agencies operate as a system of various organizational and structural units that respond to specific and reasonable situations, carry out point measures of interference, giving prescriptions, prohibitions and providing control actions in the areas, which are developing in the conformity with a law. The maintenance of public order during the elections in Ukraine is aimed not only at preventing the hazards, but considers also suspicion regarding hazards and manages to prevent risks. The article is devoted to the consideration of issues concerning the maintenance of public order by enforcement agencies during the elections and referendum. Law enforcement legal regulations of the maintenance of public order during the elections and the referendum as a special procedure of legislative settlement of activity, actions or behavior of individuals and legal entities in different spheres of public relations or on certain objects (for example, at polling stations), which includes the constitution of a mechanism to ensure the actual implementation of the system of authorizations, incentives, standards, warranties, exclusions, limitations, obligations are examined in the article. The basic features of the mechanism of administrative and legal regulation of social relations in the field of public order maintenance are disclosed.
