Топографічні додатки до протоколів слідчих (розшукових) дій: поняття, структура, значення

Abstract

Поглиблено теоретичне обґрунтування інтеграційних зв’язків топографії та криміналістичної науки, формулювання визначення поняття «топографічний додаток до протоколу слідчих (розшукових) дій», з’ясування його структури та значення для процесу доказування. Наголошено на важливості формування алгоритму дій символічного позначення за допомогою графічної мови криміналістичної інформації та її процесуального оформлення з метою забезпечення можливості використання під час кримінального провадження. The article deals with the intensification of theoretical grounding of integrative relations between topography and criminalistics science, formulation of the definition of «Topographic Applications to The Protocols of Investigative Activities», determination of the structure of this procedural document and its meaning for the criminal procedure realization. The notion of «Topographic Applications to The Protocols of Investigative Activities» is suggested to be defined as procedural document prepared by the authorized official in compliance with the Criminal Procedural code of order executed as an application to the protocol of investigative activities which presents the land section with the objects of artificial and natural origin, high-altitude positions, traffic routes, etc. which are meaningful for the criminal procedures, in the form of graphic representation (plan, scheme, map). It is suggested to single out three parts in the structure of topographic applications to the protocols of investigative activities: Introduction, graphical part (includes graphic representation and graphic explication) and circular part. It is stressed that not all aspects of investigator’s graphic activity have sufficient scientific and theoretical grounding. Thus, technologies of criminalist information recording which can optimize the process of procedural actions documenting are quite frequently ignored by certain subjects. The existence of unified rules of topographic plans and schemes execution in the form of applications to the protocols of investigative activities would facilitate the formation of clear algorithm of activities of symbolic designation of essential information with the help of graphic language and its execution in the form of procedural document for the purpose of application in the course of criminal procedure.
