Зустрічний позов як засіб захисту прав та інтересів відповідача

Abstract

Аналізуються загальні особливості зустрічного позову як спеціального засобу захисту інтересів відповідача. Розглядаються точки зору науковців щодо юридичної природи зустрічного позову, а також на підставі аналізу положень цивільного процесуального законодавства України 2012 р. досліджуються питання щодо зміни процесуально-правового статусу сторін при пред’явленні зустрічних вимог і з’ясовується факт ідентичності (за певними критеріями) зустрічної позовної заяви із первісною. In this article the author analyzes the common features of a counterclaim as a special means of the defendant’s interests protection. Different scholars’ points of view on the legal nature of the counterclaim have been considered; the issue of changes in procedural and legal status of the parties in the presentation of claims is analyzed, and the fact of counterclaims identity with the original is found out based on the analysis of the civil procedural legislations’ provision in Ukraine 2012.
