Розуміння тероризму в контексті правової антропології

Abstract

Розглянуто формулювання загальноприйнятого терміна «тероризм» за допомогою антропологічно-правової методики. Проаналізовано різні аспекти, пов’язані з проблематикою досліджень у контексті правової антропології та визначення феномена «тероризм». Розкрито етимологію терміна «те- роризм». Концептуально обґрунтовано проблему впровадження терміна «тероризм» та наведено основні підходи до його розуміння, що сприятиме підвищенню ефективності діяльності всіх інституцій громадськості у боротьбі з тероризмом. The main purpose of this writing –»Understanding terrorism in the context of legal anthropology» is the phenomenon of «terrorism» in the legal context anthropology. Research subject – terrorism as socially dangerous phenomenon that threatens the health and lives of people.The study used the following methods: general scientific (logical-historical, systematic and structural, functional) and specially-scientific (social, psychological, comparative law, and a specially-legal) methods of learning, methods of analysis, synthesis, induction, deduction, comparison and generalization and philosophical (anthropological, dialectical, hermeneutic, transcendental and anthropologically-axiological). Terrorism is increasingly perceived as a valid method of putting pressure on the government and defending personal items. In this context, and given the current political situation in Ukraine, the question of the philosophical analysis of the legal nature of terrorism is of particular relevance. The scientific novelty of this work stems from the fact that terrorism was first investigated using anthropological and legal procedures. The scientific value of the work lies in the possibility of using the material worked out and its findings in the formation of a single definition of the phenomenon of «terrorism», as well as its more deeper philosophical and legal research. The study found that the phenomenon of terrorism in the context of legal anthropology – a historical stages of identity formation, according to which it is adapted and focused on so-called «social fabric». Conceptually grounded problem of introducing the term «terrorism» and are the main approaches to the understanding that will improve the efficiency of all public institutions in the fight against terrorism.
