Окремі аспекти удосконалення інституту доменних імен в інформаційному праві України

Abstract

Порушено питання інституту доменних імен як однієї з частин інформаційного права України. Підкреслено двоїстість правової природи доменних імен як об’єкта інтелектуальної власності і об’єкта інформаційного права та змішаний характер відносин із приводу доменних імен. Формування національного правового інституту доменних імен повинно здійснюватися на підставі норм і загальноприйнятих принципів міжнародного інформаційного права. Це зумовлено необхідністю регулювання основної групи інформаційних правовідносин, що виникають у віртуальному середовищі Інтернет, який не має географічних кордонів. Система правового регулювання у сфері використання доменних імен не може вичерпуватися наявністю нормативного акта, до того ж не позбавленого низки суттєвих недоліків. Необхідно розробити комплекс законодавчих та інших норм, що забезпечує вирішення двох важливих завдань: по-перше, практичної дієвості використання доменних імен в адміністративному та цивільному обігу; по-друге, гармонізацію з міжнародними правовими актами. The development and widespread use of information and communication technology in recent decades has become a global trend of world progress. Creation, development, storage, processing, distribution and use of information resources in the global Internet is done on the domain name, which corresponds to a particular IP-address. Technology transfers of information resources in a network using domain names and network protocols, and the use of new technologies to work with information on the Internet are the subject of information relations. In addition to addressing the Internet, domain names have become individualized respective owner information resource. However, there is a gap in the legal framework deployment of domain names as individuals and various organizations responsible for maintaining the national domain zone as yet not developed clear rules relating to domain names, which would allow courts to effectively resolve conflicts between owners various means of ndividualization and owners of domain names. These factors directly affect the legal regulation of individual components of information systems and technologies that have not received legal confirmation in Ukraine in connection with the development of individual process areas in information technology to which it is advisable to include global information infrastructure (Global Information Infrastructure) and distributed systems data. The complexity of the legal institution of domain names is shown that the protection of the interests of the owners of domain names can be carried out not only because of private methods and tools, but also on the mechanisms of public information law. Formation and consideration Institute of domain names can be accomplished within the Information Law, as the object of a domain name is a complex that includes both civil and legal aspects (protection of the rights of individuals and entities as bona fide owners of domain names – the respective information resources accessed through domain) and informational aspect (protection of state interests – the owner of the relevant domain name).
