Визначення кола суб’єктів поліцейської діяльності

Abstract

Здійснено аналіз понять «правоохоронний орган», «правоохоронна діяльність», «поліцейські правовідносини», «поліцейська діяльність» з метою визначення кола суб’єктів поліцейської діяльності. Наведено позиції науковців щодо визначення критеріїв для класифікації таких суб’єктів, здійснено спробу критичного аналізу їхніх позицій. Охарактеризовано особливості органу, що здійснює поліцейську діяльність, які відрізнятимуть його від органів, наділених окремими функціями таких суб’єктів. The article analyzes the concepts of «law enforcement agency», «law enforcement», «police relationship», «police activity» in order to determine the range of subjects policing. In particular, given the position of the scholars concerning the definition of criteria for the classification of such entities, as well as an attempt to analyze these critical positions. As a result, characterized by features of the authority conducting police operations that will distinguish it from organs with separate functions such entities. Today, the process of reforming the executive branch has reached the stage of formation of the police in Ukraine, creating or redesigning the various actors who have the right of States to exercise police functions. That is, not only the internal affairs relating to the categories of policing. Terms of actors who are members of police relations is very broad. Unfortunately, attempts to classify such entities scientists in Ukraine are not numerous. In outlining their range necessary to define the basic definitions that determine a classification. Сlassification of subjects policing requires additional analysis and critical evaluation. By the police, in the narrow sense, extends the authority empowered by the state to self-realization of all functions of the police, particularly in the application of administrative coercion. Other subjects considered by us as subjects of police relations, endowed with certain police functions. For the classification of subjects policing advisable to determine the directions of such activities. In our opinion, the main ones are three. Police work can be divided into general (administrative) and specific (operational-investigative, criminal procedural and executive). General policing – policing authorized state entities of public administration, aimed at establishing and law enforcement, with the possibility of the application of administrative coercion in certain cases. Special police activity – an activity authorized by the state special subjects policing for the implementation of operational, procedural and enforcement of criminal activity under the law, defining the specific procedure for its implementation.
