Процесуальне правонаступництво при розгляді цивільного позову у кримінальній справі

Abstract

Стверджується, що процесуальне правонаступництво у кримінальному судочинстві – особливий випадок заміни сторони іншою особою (правонаступником) у разі її вибуття з процесу та у випадку переходу до неї матеріальних прав та обов’язків у встановлюваних судом правовідносинах, зазначається, що правонаступництво на боці цивільного позивача може відбуватися тільки у разі згоди правонаступника матеріальних прав та обов’язків на цю заміну і на вступ у процес. It is proved that the procedural succession in criminal justice is an exceptional case of substituting the party by another person (a successor) in the case of his leaving the procedure and in the case of the devolution of the material rights and obligations according to the legal relations established by court; it is mentioned that the procedural succession on the part of a civilian plaintiff can be realized only in the case of the successor’s of the material rights and obligations agreement to this substitution and to intervention.
