Основні функції державного нагляду та контролю у сфері освіти в Україні

Abstract

З позиції методології системного аналізу розглянуто основні функції державного нагляду та контролю у сфері освіти в Україні крізь призму Закону України «Про освіту» № 2145-VIII від 5 вересня 2017 року, метою якого є адаптація національної освітньої системи до вимог Європейського Союзу. Проаналізовано положення законодавства та інших нормативно-правових актів з питань державного управління, нагляду та контролю у контексті превентивної, охоронної, коригувальної та виховної функцій. The article deals with the basic functions of state supervision and control in the field of education in Ukraine in the light of the Law of Ukraine «On Education» No. 2145-VIII of September 5, 2017, aimed at adapting the national educational system to the requirements of the European Union. The provisions of legislation and other normative and legal acts on issues of public administration, supervision and control in the context of preventive, protective, corrective and educational functions are analyzed. Article 53 of the Constitution of Ukraine establishes the right of citizens to education, ensures the guarantee of universal accessibility, and free of charge for preschool, basic general and vocational education, higher and postgraduate education, and various forms of education; providing state scholarships and benefits to pupils and students. The implementation of the norms of the Basic Law in terms of the association of Ukraine with the European socio-economic space aims at educational reforms, one of the achievements of which is the adoption of the new Law of Ukraine «On Education». Among the guarantees of realization of the right to education that are available in the specified normative and legal act, you should draw attention to a separate section VIII «Management and control in education», dedicated to the public administration in this field. State supervision and control in the field of education are the function of authorized executive bodies of the central and local levels, which includes state control of education quality and state supervision in the sphere of education. The specified activity represents a set of preventive, checking, jurisdictional and analytical measures aimed at preventing, detecting and eliminating violations of the quality requirements of educational activity established by the legislation, implemented in the functions: preventive, protective, corrective and educational. The legal significance of state supervision and control in the field of education is manifested as a guarantee of the implementation of the principle of equality of participants of legal relations in education.
