Abstract

Навчальний посібник підготовлений відповідно до програми навчальної дисципліни «Методологія сучасного правознавства» для здобувачів освітньо-наукового ступеня доктор філософії. Тут розкрито сутність, відображено структуру та описано ґенезу методології юридичної науки. Послідовно проаналізовано засадничі елементи діалектики, герменевтики, природного права та позитивізму, прагматизму, феноменології, структуралізму та постструктуралізму, структурно-функціонального аналізу, еволюціонізму, синергетики, цивілізаційного підходу як методологічних парадигм у дослідженні проблем розуміння держави, права та юридичної практики. Адаптовано ці концепції праворозуміння до галузевих юридичних наук, зокрема на прикладі найбільш закритої сфери правовідносин – оперативно-розшукової діяльності. Посібник рекомендований для курсантів, студентів, слухачів, аспірантів, ад’юнктів, докторантів, наукових і науково-педагогічних працівників закладів вищої освіти і факультетів юридичного спрямування всіх форм навчання. The tutorial is compiled in accordance with the curriculum program of the educational discipline "Methodology of Modern Law". The textbook is intended for the applicants of the educational-scientific degree of the doctor of philosophy. The tutorial reveals the essence and the structure of the methodology of legal science and describes its genesis. Principal elements of dialectics, hermeneutics, natural law and positivism, pragmatism, phenomenology, structuralism and post-structuralism, structural and functional analysis, evolutionism, synergetics, civilizational approach as methodological paradigms in the study of problems of understanding of a state, law and legal practice are analyzed. These concepts of legal understanding are adapted to branch legal sciences, in particular on the example of the most closed sphere of legal relations - operational-search activity. The manual is recommended to cadets, students, postgraduates, adjuncts, doctoral students, scientific and pedagogical staff of institutions of higher education and faculties of the legal direction of all forms of study.
