Щодо питання надання засудженим паліативної допомоги: реалії сьогодення

Abstract

У статті розглядається питання, що гуманізації покарання у чинному кримінальному законі, детально розглядається питання щодо особливостей та проблем застосування до особи засудженого інституту звільнення від покарання за хворобою, а також недоліки, які при цьому існують. Роглядається зміст права засудженого на охорону здоров’я під час відбування ним покарання, а також зауваження до лікування засуджених та до медико-санітарного забезпечення їх діагностування, а також можливості одержання особами, які відбувають покарання паліативної допомоги, як одного із видів медичної допомоги. The article discusses the issue that the humanization of punishment under the existing criminal law, are examined in detail concerning the characteristics and problems of the application to the person convicted of the Institute of exemption from punishment for a disease, but also the shortcomings which exist. Roglages the content of the right of the convict to health while serving his punishment, as well as comments on the treatment of prisoners and the health of their diagnosis. Today, unfortunately, there is a high mortality rate in penal institutions, which is clearly caused primarily by failure to provide proper medical care (e.g. delayed diagnosis, treatment not fully, the delay in treatment and the like). Also a large number of complaints of prisoners that relate to exactly improper medical care, failure to provide inpatient treatment and go annually to the Commissioner of the Verkhovna Rada of Ukraine on human rights. So, all this requires a deep analysis of a question concerning a more effective use of the institution of release from punishment and the possibility of applying palliative care to convicted prisoners. In fact often there are cases when the Prosecutor's office revealed a number of violations while respecting the rights of prisoners to receive adequate medical care in places of deprivation of liberty. For example, States medical parts of some correctional facilities are understaffed or doctors do not perform properly the duties of their offices respectively, shall have the effect of not getting adequate professional and timely medical care securename, or even leads to their death. Explores opportunities for persons serving sentences in palliative care as one of the types of medical care.
