У статті підтримується висловлена в науковій літературі пропозиція закріплення за позивачем можливості клопотання про скасування ухвали про залишення заяви без розгляду у зв'язку з його повторною неявкою в судове засідання у суді що її постановив, а також запропоновано механізм реалізації позивачем цього права.
