Правове регулювання земельних та тісно повʼязаних із ними відносин органами місцевого самоврядування у контексті державної регуляторної політики

Abstract

Заналізовано правове регулювання земельних і тісно повʼязаних із ними відносин органами місцевого самоврядування у контексті державної регуляторної політики, визначено межі такого регулювання на відповідній території. Розглянуто найбільш поширені повноваження органів місцевого самоврядування у сфері регулювання земельних та повʼязаних із ними відносин в Україні. Зʼясовано, що рішення органів місцевого самоврядування нормативного характеру у зазначеній сфері мають здебільшого регуляторний характер, а тому повинні готуватися і прийматися з дотриманням відповідної процедури та з урахуванням принципів державної регуляторної політики з метою забезпечення їхньої якості та ефективності. The article is devoted to the analysis of legal regulation of land and relations, which are closely connected with local self-government bodies in the context of state regulatory policy, determination of the boundaries of such regulation in the respective territory. Particularly relevant issue of regulation of land relations by local self-government bodies is due to the implementation of land reform in Ukraine and the reform of decentralization of power, the creation of united territorial communities. Acquiring new quality requirements for local normative legal acts, which fall under the signs of a regulatory act, and procedures for their adoption by bodies of local self-government. Thence, a significant number of normative legal acts of local selfgovernment bodies will have the nature of regulatory acts, as their characteristic feature is, in particular, the focus on the legal regulation of economic relations or administrative relations between the regulatory authorities or other bodies of state power and economic entities. The principles of the state regulatory policy are analyzed, whereas it is precisely because of the prism of these principles, taking into account the features of the regulatory act and the local self-governing lawmaking limits. It is expedient to investigate the regulatory activity of local self-government bodies in relation to the preparation and adoption of certain legal acts, including in the field of regulation of land and closely related relations. The evaluation of the most common authority of the local self-government bodies in the field of the regulation of land and related relations in Ukraine was carried out. It is noted that the decisions of local government bodies of the regulatory nature in this area are, in the majority of the cases, of a regulatory nature and should be prepared and adopted in compliance with the relevant procedure and taking into account the principles of the state regulatory policy in order to ensure their quality and efficiency. The management of the regulatory function of local selfgovernment bodies has the establishment of cases of such regulation. The conclusion is made on the need to extend the powers of local selfgovernment bodies in the field of land and closely related relations in connection with the implementation of land reform and the reform of decentralization of power.
