Технічні засоби автоматичної фіксації адміністративних правопорушень як засіб профілактики правопорушень у сфері дорожнього руху

Abstract

У статті розглянуто проблеми застосування технічних засобів автоматичної фіксації адміністративних правопорушень як засобу профілактики правопорушень у сфері дорожнього руху в Україні. Особливу увагу приділено стану нормативно-правого регулювання застосування технічних засобів автоматичної фіксації в забезпеченні безпеки дорожнього руху. На підставі дослідження робіт фахівців з адміністративного права та інших галузей права, зроблено висновки щодо необхідності дослідження проблем застосування технічних засобів у сфері забезпечення безпеки дорожнього руху. Зазначається, що сучасний розвиток доктрини адміністративного права створив підґрунтя до таких висновків, дозволив відійти від традиційних поглядів на контроль і нагляд у сфері дорожнього руху. The strategy of development of the system of the Ministry of Internal Affairs of Ukraine until 2020 for ensuring public spinning and public security envisages improvement of crime prevention and other offenses, development and use of special means aimed at reducing the level of criminalization of public relations. One of the directions of preventive activity is to ensure road safety through the use of technical means of automatic fixing of administrative offenses. The implementation of the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their Member States, on the other hand, aims to reduce the level of injuries and traffic accidents in Ukraine, which is possible, as the experience of the countries shows. EU, thanks to technical means. The article deals with the problems of using the technical means of automatic fixing of administrative offenses as a means of preventing road traffic offenses in Ukraine. Particular attention is paid to the state of regulatory and legal regulation of the use of technical means of automatic fixation in road safety. On the basis of the research of the work of specialists in administrative law and other branches of law, the conclusions were made regarding the necessity of researching the problems of the use of technical means in the field of traffic safety. It is noted that the modern development of the doctrine of administrative law has created the basis for such conclusions, allowed to depart from the traditional views on control and supervision in the field of traffic. A promising area of further research is to improve the regulatory and legal regulation of the use of technical means of automatic fixing of administrative offenses in order to increase the efficiency of road safety.
