Соціальний захист безробітних в міжнародному праві: теоретико-правові аспекти

Abstract

Статтю присвячено дослідженню соціального захисту безробітних осіб в міжнародному праві. Висвітлено чинники та тенденції безробіття. Охарактеризовано міжнародно-правові стандарти соціального захисту безробітних осіб на основі аналізу галузевих міжнародно-правових актів. Проаналізовано норми соціального забезпечення, у Конвенції МОП № 2 «Про безробіття», Конвенції МОП № 102 «Про мінімальні норми соціального забезпечення», Конвенції МОП № 122 «Про політику в галузі зайнятості», Конвенції МОП № 168 «Про сприяння зайнятості та захист від безробіття». Запропоновано результати проведеного порівняльного аналізу та оцінювання відповідності національних норм вимогам. Аналізуються ключові нормативні акти найавторитетніших міжнародних організацій, в яких розкриваються проблеми соціального захисту безробітних. The article is devoted to the study of social protection of unemployed persons in international law. The factors and trends of unemployment are covered. International legal standards of social protection of unemployed persons are characterized on the basis of the analysis of sectoral international legal acts. Social security norms are analyzed in ILO Convention No. 2 «On Unemployment», ILO Convention No. 102 «On Minimum Social Security Standards», ILO Convention No. 122 «On Employment Policy», ILO Convention No. 168 «On Promoting Employment and Protection against Employment unemployment». The results of the comparative analysis and assessment of compliance with national standards are offered. The key normative acts of the most reputable international organizations are analyzed, which reveal the problems of social protection of the unemployed. Unemployment is a socio-economic phenomenon in which the number of job seekers is greater than the number of jobs. The employment of working-age population has a negative social and economic impact on the entire population of the region. The problem of unemployment needs immediate consideration by the authorities and a solution. Unemployed, according to the International Labor Organization, are those who do not currently have a job or other gainful employment, are actively seeking work and are ready to start work within the next two weeks. There are many reasons for unemployment. These include: structural changes in the economy of a country or region, decreasing or limiting demand for goods or services, continued development of technology, fnding new jobs with better wages or more meaningful jobs, demographic changes in composition and size of the workforce, lack of mobility. Every country faces the problem of unemployment at different stages of its development. Its decision is inevitable and depends frst of all on the main causes of unemployment, the number of unemployed population and the level of economic development of the country.
