Гарантії нотаріального процесу як складові гарантій нотаріальної діяльності в Україні

Abstract

Питання захисту прав та законних інтересів фізичних та юридичних осіб, що звертаються за вчиненням нотаріальних дій до нотаріальних органів, завжди перебувало під пильним оком держави. Особливо від якості та своєчасності наданих нотаріальних послуг певною мірою залежить ставлення до нотаріуса пересічного громадянина. Проаналізовано гарантії нотаріального процесу як складових гарантій української нотаріальної діяльності. Автор пропонує увідповіднити нормам нового Кримінального процесуального кодексу України частину третю статті 8-1 «Гарантії нотаріальної діяльності» Закону України «Про нотаріат». The issue of protecting the rights and legitimate interests of individuals and legal entities applying for notarial acts to notarial bodies has always been under the watchful eye of the state. Particularly in terms of the quality and timeliness of the notarial services provided, the attitude towards the average citizen of the notary depends to a certain extent. The article analyzes the guarantees of the notarial process as an integral part of the guarantees of Ukrainian notarial activity. The author proposes to bring in the part of the third article 8-1 «Guarantee of notarial activity» of the Law of Ukraine «On Notary» in accordance with the norms of the new Criminal Procedural Code of Ukraine.
