Короткий огляд (реферат): Нотаріальна діяльність – це специфічна правова форма юридичної діяльності, в межах якої здійснюється застосування правових норм шляхом реалізації нотаріусом юрисдикційних повноважень по безспірних справах. Від компетентності, добросовісності та чесності нотаріуса в певній мірі залежить якість вчинюваних ним нотаріальних дій. Метою статті є проведення комплексного наукового аналізу становлення інституту нотаріальної присяги від зародження нотаріату до сьогодення та дає змогу глибше зрозуміти специфіку розвитку вказаного інституту, так і нотаріату загалом. - дослідженні використано загальнонаукові та спеціальні методи дослідження. Основу дослідження складають наступні методи: історично-правовий, структурно – функціональний, порівняльний та метод комплексного аналізу. Автор стверджує, що інститут нотаріальної присяги походить з древніх часів, підтвердженням цього є норми Візантійської «Книги Епарха». - більшості європейських країн інститут нотаріальної присяги є необхідною умовою доступу до професії нотаріуса та регулюється державним нотаріальним законодавством. Наприклад, в У країни це питання вперше було врегульовано статтею 6 Закону України «Про нотаріат» від 2 вересня 1993 року. Подальші розвідки інституту нотаріальної присяги передбачатимуть розгляд конкретних випадків прийняття присяги окремими нотаріусами на різних етапах розвитку нотаріальної діяльності. Notarial activity is a specific legal form of legal activity, within which the notary carries out the application of legal norms through the exercise of jurisdictional powers on indisputable matters. The quality of notarial acts depends on the competence, good faith, and honesty of the notary. The purpose of the article is to conduct a comprehensive scientific analysis of the formation of the institution of notary oath from the initiation of the notary service board to the present time. It gives the opportunity to deeper understand the peculiarities of the development of the institution of notary oath and the notariate in general. The author uses general scientific and special research methods. The basis of the study are the following methods: historical and legal, structural and functional, comparative and method of complex analysis. The author states that the institution of notarial oath originates from ancient times, confirmation of which is the norms of the Byzantine "Book of Eparch". In most European countries, the institution of notary oath is a prerequisite of access to the profession of notary and state notary public law governs it. For example, in Ukraine, this issue was first regulated by Article 6 of the Law of Ukraine "On Notariate" of September 2, 1993. Further investigations of the institution of notary oath will include consideration of specific cases of administering oaths by individual notaries at different stages of the development of notarial activities.
