Польський досвід підготовки юристів до роботи з науковими доказами у кримінальному провадженні

Abstract

При обговоренні проблеми підготовки юристів до роботи з науковими доказами у кримінальному провадженні виконані дослідницькі завдання: з’ясовано сутність концепту "наукові докази" у науці та судово-слідчій практиці; описано проблемний характер підготовки правників до роботи з такими доказами та шляхи його оптимізації в Республіці Польща; визначено напрямки вдосконалення освітнього процесу майбутніх працівників поліції, прокурорів, слідчих в Україні. Сформульовано наступні висновки: поняття "наукові докази" є новим для української науки, однак його застосування відповідає світовій практиці, відтак вбачається доцільність його імплементації в доктрину кримінального процесуального права; польська наукова спільнота працює над оптимізацією підготовки майбутніх правників до роботи з науковими доказами. Втім існуючі відмінності і в кримінальному провадженні, і в функціонуванні закладів освіти не дозволяють здійснити автоматичний трансфер польського досвіду в Україну. There is no similar definition of "scientific evidence" in modern Ukrainian science and judicial practice. However, according to the results of the research, foreign lawyers widely apply this concept. Moreover, they say that we are entering into the "century of scientific evidence". The reason for such emphasis on the scientific component is provoked by the trend of continuous strengthening and improving the possibilities of using special knowledge for the realization of the tasks of criminal proceedings. At the same time, there is the question – are police officers, investigators, prosecutors and judges ready for effective work with scientific evidence? A high level of professionalism in work with evidence is one of the core principles of the legal profession. So the purpose of this publication is to substantiate the need of strengthening forensic education in Ukraine and identify areas for improving the lawyers training system for high-quality and productive work with scientific evidence on the crime scene, during the investigative process and in the courtroom. The generalization and detailed study of Polish experience have become the basis of the study in this field. The author sets the following research goals: firstly, to find out the essence of the definition of "scientific evidence" in forensic science and practice; secondly, to describe the problematic nature of the preparation of lawyers for working with such evidence in Poland; third, to determine the direction of improving efficiency the educational process for future police officers, prosecutors, investigators and judges in Ukraine. It is important to implement some of the best practical recommendations to support the goal of improving forensic science and education. Particular attention was paid to the discussion of the Daubert standard of the expert opinion evaluation by the court, no scientific evidence (junk science), a critical assessment of the level of education of Polish and Ukrainian lawyers, an assessment of the prospects for reforming education. The comparative study made possible conclusions and suggestions of the ways of strengthening forensic education in Ukraine.
