Принципи процесуального режиму державного нагляду (контролю) у сфері діяльності МВС України

Abstract

Здійснено теоретико-правове дослідження принципів процесуального режиму державного нагляду (контролю) у сфері діяльності МВС України у контексті адаптації національного законодавства до вимог Європейського Союзу. Проаналізовано підходи до визначення загальнопроцесуальних принципів нагляду (контролю) та спеціалізованих принципів нагляду (контролю) в діяльності органів МВС України і їх реалізації у практичній діяльності. Визначено, що формування спеціалізованих принципів державного нагляду (контролю) залежить від закономірностей, які впливають на систему державного нагляду (контролю), їх зміст є відображенням соціально-економічної та політичної ситуацій в країні. На кожному етапі адміністративної реформи принципи державного нагляду (контролю) вбирають найбільш важливі прогресивні ідеї, необхідні для реформування системи державного нагляду (контролю) з метою її вдосконалення та підвищення ефективності контрольно-наглядової діяльності. The article deals with the theoretical and legal study of the principles of the procedural regime of state supervision (control) in the feld of activity of the Ministry of Internal Affairs of Ukraine in the context of adaptation of the national legislation to the requirements of the European Union. The analysis of approaches to defnition of the general procedural principles of supervision (control) and specialized principles of supervision (control) in the activity of bodies of the Ministry of Internal Affairs of Ukraine and their implementation in practical activity is carried out. Supervision (control), their content is a reflection of the socio-economic and political situation in the country. At each stage of administrative reform, the principles of state supervision (control) absorb the most important progressive ideas needed to reform the system of state supervision (control). It is proved that the administrative and procedural regulation of state supervision (control) in the feld of activity of the bodies of the Ministry of Internal Affairs of Ukraine, its current state are characterized by certain negative features that require improvement. The legislation on state supervision (control) consists of a large number of contradictory normative and legal acts and other legal documents, the rules of which include issues that give rise to legal conflicts in the legal feld. The imperfection of the current system of principles of state supervision (control), on which the entire system of state supervision (control) is built and operates, does not allow forming an optimal model of the relationship between controlling and controlled entities. The practical implementation of the means of control and supervision is due to the presence of a wide set of discretionary powers of ofcials of the Ministry of Internal Affairs of Ukraine; as a result, the rights of controlled entities are violated.
