Abstract

Комплексно розглядається проблема становлення і розвитку сімейного права Другої Речі Посполитої у 1918–1939 рр. З’ясовано особливості застосування шлюбно-сімейних правових норм, відповідно до чинних нормативних актів, залежно від об’єднаних регіонів. Охарактеризовано основні інститути сімейного права, такі як шлюб, розлучення, сепарація, особисті немайнові та майнові права і обов’язки подружжя, батьків та дітей. Виявлено особливості укладення, розірвання шлюбу, визнання шлюбу недійсним залежно від віросповідання подружжя. Проаналізовано основні умови укладення шлюбних договорів, охарактеризовано права та обов’язки батьків та дітей, що виникали зі шлюбної та позашлюбної спорідненості. The problem of the formation and development of family law in the Republic of Poland in 1918–1939 is considered in the thesis. The peculiarities of applying the matrimonial legal rules according to the standard acts in force and depending on the united regions are clarified. The main institutions of family law such as marriage, divorce, separation, personal non-property and property rights and duties of the conjoints, parents and children are characterized. The peculiarities of effecting a marriage and divorce, avoidance of a marriage depending on the denomination of the conjoints are revealed. The main conditions of contracting a marriage are analyzed; the rights and duties of the parents and children that appeared from the marital and extra-marital relations are characterized.
