Abstract

Наукову роботу присвячено розв’язанню науково-прикладної проблеми щодо вдосконалення правового регулювання страхування в туризмі. Проаналізовано доктринальні підходи до терміна «страхування в туризмі» та запропонована авторська дефініція. Розкрито основні ознаки страхових відносин у сфері здійснення туристичної діяльності й запропоновано їх класифікацію. Визначено особливості здійснення інформування туристів про умови страхування. Досліджено правову природу договірних конструкцій, які опосередковують надання страхових туристичних послуг. Розкрито зміст таких умов договору, як страховий ризик, страховий випадок, страховий платіж. Окрема увага приділяється формі договору туристичного страхування. Охарактеризовано основні види та форми туристичного страхування й обґрунтовано необхідність розширити коло обов’язкових видів страхування. За результатами проведеного дослідження запропоновано внести зміни до Законів України «Про страхування» та «Про туризм». The scientific work is devoted to solving the scientific and applied problem of improving the legal regulation of insurance in tourism. The doctrinal approaches of the term «insurance in tourism» are analyzed and the author's definition is offered. The main features of insurance relations in the field of tourism are revealed and their classification is proposed. Peculiarities of informing tourists about insurance conditions are determined. The legal nature of contractual constructions that mediate the provision of travel insurance services has been studied. The content of such terms of the contract as insurance risk, insured event, insurance payment is revealed. Particular attention is paid to the form of travel insurance contract. The main types and forms of travel insurance are described and the need to expand the range of compulsory types of insurance is substantiated. According to the results of the study, it is proposed to amend the laws of Ukraine «On Insurance» and «On Tourism».
