Європейський ордер на проведення розслідування

Abstract

У статті проаналізовано інститут міжнародного співробітництва – Європейський ордер на проведення розслідування. Здійснено аналіз положень однойменної Директиви Європейського парламенту і Ради Європейського Союзу № 2014/41, яка регулює порядок видачі та виконання Ордера. Запропоновано власне авторське визначення Європейського ордера на проведення розслідування та пропозиції щодо доповнення тексту Директиви в контексті захисту прав суб’єктів кримінального провадження. An institute of international cooperation – European Investigation Order – is analyzed in the article. The provisions’ analysis of the same name Directive 2014/41/EU of the European Parliament and of the Council, which regulates the issuing and execution of the Order has been conducted. The own authorial defnition of the European Investigation Order has been proposed as well as the proposals concerning the supplement to the Directive in the rights protection sphere of subjects of criminal proceeding.
