Цивільно-правова природа поняття юридичної особи

Abstract

У статті з урахуванням наукових поглядів вчених проаналізовано таке актуальне питання цивільного права, як поняття "юридична особа". Для характеристики поняття «юридична особа» використовується логічна конструкція поєднання змісту і обсягу. Дана тема актуальна також з тієї причини, що юридична особа є окремим суб'єктом правовідносин, з певним набором прав і обов'язків, відмінних від прав і обов'язків інших суб'єктів права. У статті проаналізовано наукові позиції щодо визначення самого поняття «юридична особа», а також змісту його ознак. Це дозволить знайти правильний підхід до розуміння сутності юридичної особи. Визначено деякі особливості юридичної особи, а також виділено його кваліфікуючі ознаки. Обсяг поняття охарактеризований шляхом виділення видів юридичних осіб за різними кваліфікаційним критеріям. In the article, taking into account the scientifc views of scientists, such an urgent issue of civil law as the concept of a legal entity is analyzed. To characterize the concept of a legal entity, a logical construction of the combination of content and volume is used. This topic is also relevant for the reason that a legal entity is a separate subject of legal relations, with a certain set of rights and obligations different from the rights and duties of other entities. The article analyzes the scientifc positions regarding the defnition of the term legal entity and the content of its features. This will allow you to fnd the right approach to understanding the essence of the legal entity. Some features of a legal entity are identifed, as well as its qualifying features. The scope of the concept is characterized by distinguishing types of legal entities by different qualifcation criteria.
